General Information About Recording Functions and Procedures

Recording Hours:  Weekdays 8:30 a.m to 5:00 p.m., except holidays

Introduction

The County Clerk’s Office records documents that affect title to real property located in Malheur County, Oregon.  When a document is received for recording it is checked for compliance with Oregon statues.  If a document cannot be recorded, it is returned to the sender with an explanation of what is wrong.  After a document is recorded an index is created and the image scanned for document retrieval.  All recorded documents are microfilmed and archived.

This office is prohibited from:

  • Giving legal advice
  • Helping fill out documents
  • Suggesting what type of documents to use
  • Accepting illegible documents
  • Recording documents other than those specified by Oregon and federal law

Fees are required at the time a document is presented for recording and accepted in the following formats only:  cash, check or money order.


ATTENTION:  Due to Senate Bill 618 and its emergency passage (immediate), all Service Discharge records are confidential and requests/searches must be made in writing and will be completed as time allows by office staff.  Also due to SB 618, all other public records from 1973-1983, are restricted from public access and will need to be requested in writing and will be completed as time allows by office staff.

       Deeds, mortgages, liens, mining, County Court journal (1973 and older Mortgage and 1959 and older Mining records are in storage and require 24 hour notice to provide access to.)

Passports - 1st time Applicants

Applications are accepted between 8:30 am & 4:30 pm, Monday thru Friday except holidays.  All persons applying for a passport must be present, including infants and children.  Both parents must be present when applying for children under 16.

Forms are available at the Malheur County Clerks Office (Vale), Ontario Post Office and on line @ http://travel.state.gov/

When completing the form do NOT use white out, line through errors with 1 line.

DO NOT sign the application.  The application must be signed in front of the Accepting Agent.

All applicants must have

  • State certified Birth Certificate or Naturalization Certificate (photocopies not allowed)
  • 2 Identical Photos specifically for Passports
  • Photo ID (Driver's License) - Both Parents ID if applying for minor children
  • Check or Money Order (for each application)
  • Acceptance Agent (Clerks Office) fee - Check, Money Order or Cash

Marriage Licenses

  • Licenses issued between 8:30 am and 4:30 pm, including lunch hour
  • Both parites must come in to our office, with ID
  • $60 Cash (exact amount) or Money Order
  • We do NOT perform marriage ceremonies, individuals must make separate arrangements

  • Issued between 8:30 am and 4:30 pm, including lunch hour
  • Both parties must come in to our office, with ID
