IN THE COUNTY COURT OF THE STATE OF OREGON

FOR THE COUNTY OF MALHEUR

 

IN THE MATTER OF SUPPORTING                              )

SECOND AMENDMENT RIGHTS                                  )  Resolution No. R15-23

)

 

WHEREAS, the Second Amendment to the Constitution of the United States of America states:  “A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed;” and

WHEREAS, Article 1, Section 27 of the Oregon Constitution states:  “The people shall have the right to bear arms for the defense [sic] of themselves, and the State, but the Military shall be kept in strict subordination to the civil power;” and

 

WHEREAS, the County Court of Malheur County feel that public recognition of the Constitutions of the United States of America and Oregon are the documents that protect and preserve our democracy and liberty; and

 

WHEREAS, the County Court of Malheur County also recognizes that the first and last protectors of the Constitutions of the United States of America and Oregon are the people of the United States and Oregon, and that the ability of the people to fulfill that role rests in large part on the people’s right to bear arms as stated in the Constitutions of the United States of America and Oregon; and

 

WHEREAS, the significant majority of all lawfully owned firearms in the United States will not be used in a crime in any given year; and

 

WHEREAS, state and federal lawmakers continue to propose measures aimed at restricting all firearms and ammunition including, bans, taxation, extensive waiting periods, registration, licensing and even confiscation; and

 

WHEREAS, the Oregon Legislature has passed Senate Bill 941 requiring background checks for many firearms transactions and created criminal penalties for violations of the law; and

 

WHEREAS, Senate Bill 941 contains an unfunded mandate for Malheur Count government in the form of investigations, enforcement, prosecution and incarceration; and

 

NOW, THEREFORE, the Malheur County Court hereby Orders and Resolves as follows:

 

  1. Malheur County strongly affirms our commitment to the rights and liberties enshrined within the Constitutions of the United States of America and Oregon, including but not limited to the right to keep and bear arms; and

 

  1. Malheur County opposes any state or federal law that abridges or is contrary to the provisions of the Constitutions of the United States of America and the State of Oregon preserving the people’s right to keep and bear arms; and

 

  1. Malheur County strongly supports the right of the people to keep and bear arms as stated in the Constitutions of the United States of America, and Oregon as interpreted by the United States Supreme Court and Oregon Supreme Court, and vigorously opposes any state or federal law that unfairly and unconstitutionally restricts these rights; and

 

  1. Malheur County is unable to expend any county resources for the implementation and enforcement of Senate Bill 941. Senate Bill 941 is an unfunded mandate.
