NOTICE:

RESCHEDULED: The Malheur County Court will conduct a public hearing October 10, 2018 at 9:00 a.m. at the Malheur County Courthouse, 251 B S. West, Vale, OR, Room 107, on the appeal of a Malheur County Planning Commission decision to approve the application of Derrick McKrola, representative for owner of record, Galen & Sharlyn Jantz, for a conditional use permit for a non-farm dwelling and a non-farm partition in the Exclusive Farm Use zone pursuant to MCC Title 6, Chapter 6, Conditional Uses 6-3A-3(P) and ORS 215.283. The general approval criteria for conditional use permit applications are set forth in MCC Title 6, Chapter 6, Conditional Uses 6-6-7. The specific approval criteria for non-farm dwellings and non-farm partitions are set forth in MCC Title 6, Chapter 6, 6-6-8-1 and 6-6-8-2 respectively. The hearing is limited to the record created at the Planning Commission hearing and will be conducted by the procedures in MCC Title 6 Chapter 13. Any interested person may appear at the hearing. Failure of an issue to be raised in a hearing, in person, or letter, or failure to provide sufficient specificity to afford the decision maker an opportunity to respond to the issue precludes appeal to the Land Use Board of Appeals on that issue.
The property is described by Assessor records as tax lot 700, Section 16, T. 18S., R. 45E., W.M. The property is owned by Galen & Sharlyn Jantz and is located northeast of Vale on Vale View Road. Directions to the property are as follows: from the intersection of A Street and Main Street, Vale, head north on US Hwy 26 for 1.8 miles; turn right onto Kochsmeier Road for 0.2 miles; turn right onto Vale View Road for 1.5 miles; the parcel is on the right before the grain elevators.
