Applicant B: Anchorman Properties LLC – a proposed amendment to Nyssa Urban Growth Area and zone change from Nyssa-R2/UGA to Nyssa-C/UGA. Tax Lot 1000, Section 32, T.19S, R.47E, W.M.; Malheur County Ref. #9728; Planning Department File #2020-10-011. The property is located 1/4 mile south of the intersection of Adrian Blvd and Beck Rd, in Nyssa, OR. The criteria for the proposed amendment are listed in the Joint Management Agreement between Nyssa and Malheur County, Nyssa City Code 9-4E & 9-4F, Statewide Planning Goals 1, 2, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14 and respective administrative rules.
Applicant C: New Cingular Wireless PCS, LLC – the Consideration of: (1) Conditional Use permit for a wireless telecommunication facility, and (2) Sage Grouse Rule Permit pursuant to Oregon Administrative Rule (“OAR”) 660-023-0115 for a 450 foot wireless telecommunication tower approximately 1400 ft east of Hwy 78, at the Western boarder of Malheur County, on a DSL, 5,301.04 acre parcel, in the Exclusive Range Use Zone, and generally described as tax lot 100 on Malheur County Assessor’s Map 28S37E, Malheur County Ref#15740. Malheur County Planning Department File: 2021-01-003. The criteria for the proposed conditional use permit: MCC 6-6-7, 6-6-8, 6-6-8-8 and of the Malheur County Comprehensive Plan: Goals 3, 5, 11 and respective administrative rules.
Applicant D: Jacob Tollman – the Consideration of a Conditional Use Permit for a Non-Farm Dwelling in Exclusive Farm Use zone pursuant to MCC Title 6, Conditional Uses 6-6-7, 6-6-8-1 and OAR 660, Division 33, Agricultural Lands. Tax Lot 300, Section 25, T.22S, R.46E, W.M. Planning Department File #2020-12-012; Malheur Co. Ref. #10960. The property is located about 1 mile east of the intersection of Succor Creek Hwy and Hwy 201 S on US Hwy 201-S, in Adrian OR.

Testimony, arguments and evidence must be directed toward the criteria set out above, or other substantive criteria in Malheur County’s Comprehensive Plan or land use regulations that the person believes apply to the application.
Failure to raise an issue at the hearing, in person, or by letter, or failure to provide sufficient specificity to afford the Planning Commission an opportunity to respond to the issue precludes an appeal to the Malheur County Court or the Land Use Board of Appeals based on that issue.
A copy of the application, all documents and evidence submitted by or on behalf of the applicant and applicable criteria are available for inspection at the Malheur County Planning Department Monday – Friday from 8:30 a.m. – 12:00 (noon) and 1:00 p.m. to 4:30 p.m. or on the county website www.malheurco.org/planning-department at no cost. Copies can be provided for $0.25 per page. In addition, copies of the Staff Report will be available at least seven (7) days prior to the hearing at a reasonable cost or can be viewed on the County website or in the planning department office at no cost.
